Welcome to SiyaTutor, an AI-powered WhatsApp-based tutor bot designed to provide educational support for students in grades 1 to 12, covering all major subjects. These Terms of Service govern your use of SiyaTutor. By accessing or using our services, you agree to comply with these Terms of Service. If you do not agree with any part of these terms, please do not use SiyaTutor.

Use of SiyaTutor:

1.1 Eligibility: You must be at least 13 years old to use SiyaTutor. By using our services, you affirm that you are at least 13 years old or have obtained parental consent.

1.2 Account Registration: To access SiyaTutor, you may need to join the Whatsaoo account.

1.3 Prohibited Activities: While using SiyaTutor, you agree not to engage in any of the following activities: a. Violating any applicable laws, regulations, or third-party rights. b. Attempting to interfere with the proper functioning of SiyaTutor or its infrastructure. c. Uploading, transmitting, or distributing any content that is illegal, harmful, offensive, or violates the rights of others. d. Engaging in any form of fraudulent or deceptive behavior. e. Accessing or attempting to access any unauthorized areas of SiyaTutor or its systems.

Intellectual Property:

2.1 SiyaTutor Content: All intellectual property rights in SiyaTutor, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of SiyaTutor or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

2.2 Limited License: SiyaTutor grants you a limited, non-exclusive, non-transferable license to access and use SiyaTutor solely for your personal, non-commercial use. You may not reproduce, modify, distribute, display, perform, or otherwise use any part of SiyaTutor without the express written permission of SiyaTutor.

Disclaimer of Warranties:

3.1 SiyaTutor is provided on an "as is" and "as available" basis. We do not warrant that SiyaTutor will be uninterrupted, error-free, or free from viruses or other harmful components. We disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability:

4.1 To the extent permitted by applicable law, SiyaTutor and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses arising out of or in connection with your use of SiyaTutor.

Modifications and Termination:

5.1 SiyaTutor reserves the right to modify, suspend, or terminate the services at any time without prior notice. We may also modify these Terms of Service from time to time. It is your responsibility to review these terms periodically for any changes. Your continued use of SiyaTutor after the posting of any modifications constitutes your acceptance of such modifications.

Governing Law and Jurisdiction:

6.1 These Terms of Service shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

Severability:

7.1 If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement:

8.1 These Terms of Service constitute the entire agreement between you and SiyaTutor regarding your use of SiyaTutor and supersede any prior agreements or understandings, whether written or oral.
